On January 23rd the City swept an encampment (before the 48 hour posted time) referencing the camping ban to justify the sweep. Andy Phelps, the Director of Encampment Response for the City of Denver, told people there were “over 80 shelter beds available” in effort to justify the sweep.
However, later we received raw data from the City with shelter bed capacity and usage and the day this sweep happened when he said there were “over 80 shelter beds” shelters were in fact over capacity!!@# No beds were available.
This is a clear case in point that City directors are not in touch with reality and that no “justification” of camping ban enforcement can legally take place while shelter beds are over capacity.
