FOR IMMEDIATE RELEASE: Motion to Suspend Camping Ban During Class Action
Trial in the Denver Homeless Class Action begins in six weeks on March 19, 2019. This motion, filed in the US District Court of Colorado this morning, seeks a Federal Court order mandating that the City of Denver suspend Camping Ban Enforcement one week prior to, and through, the 10-day trial—March 12 through March 29, 2019—so that the Plaintiff Class made up of 5,500 plus homeless persons will not be harassed, detained, or otherwise deterred from giving their testimony at trial.
As you can read in the Introduction, there is a right of access to justice that arises from the First, Fourth and Fourteenth Amendments to the US Constitution.
