Denver, CO. Lawsuit Filed Against the Sweeps and the City’s Ongoing Violations of Lawsuit Settlement

Today, October 5th 2020, a lawsuit and motion for preliminary injunction was filed against the City of Denver for violating constitutional rights of homeless individuals, and violating the agreed upon settlement from Lyall v CIty of Denver, in on-going sweeps. The suit is filed by Andrew McNaulty of Killmer Lane and Newman on behalf of 10 homeless individuals as well as all others in the class of homeless people and those of us from Denver Homeless Out Loud who have suffered from sweeps. This case seeks an injunction to stop the homeless sweeps (and enforcement of the Camping Ban) during the COVID-19 pandemic (and afterwards), the seizure of homeless individuals’ property without notice, the destruction of homeless individuals’ property, and the continuing violation of the Lyall v. Denver settlement agreement. 

This lawsuit comes after a series of egregious sweeps conducted by the City with no notice at Lincoln Park at the end of July, Morey Middle School at the beginning of August, and along the South Platte River a week ago. In addition, at least 20 other sweeps, plus daily camping ban enforcement, have continued to occur during the COVID-19 pandemic. 

The City cannot continue to blatantly violate the rights of people without housing and furthermore violate the settlement agreement they made with the homeless community to give proper notice prior to sweeps and to store property instead of trashing it. The City cannot continue to ignore CDC guidance to not sweep and to instead provide sanitation resources where people live in encampments. 

Plaintiffs in this case lost medications, irreplaceable memorabilia, all their protection from the elements, and have been pushed into congregate shelters where one lead plaintiff with a heart condition could have died when they caught COVID.

Our City refuses to listen to the cries of the people to stop this inhumane insanity, so we have no choice but to take this cry to the courts.

With the intensified attacks on all of our communities; artwork remains a powerful tool to share our experiences, understand each other’s struggles, and broaden the collective fight for a better future. 
Since the passage of the Big Fascist Bill, communities in man-made vulnerable positions face even harsher hostilities from shrinking accessibility to social services to criminalization of queer and trans people to the kidnapping of our immigrant neighbors. The list goes on and on but we won’t let these fascists take away our dignity, instead we will come together and bridge our fights! 

The way through is together! 

Let us sing. 
Let us dance. 
Let us break bread. 

Let us come together to learn about each other’s struggles and share resources. The evening will also include a raffle showcasing swag from WRAP members, local artist contributions, and many more!!!

Sweeps are a way to push people further into the m Sweeps are a way to push people further into the margins of society and out of the public eye. They are a sham response to a manufactured issue. Sweeps will never solve homelessness, instead they play into the vicious cycle of homelessness. 

Organizers keep fighting back! Our outreach to the community tells us the trends of criminalization, dehumanization, & a gap in actually moving towards viable solutions are on full display. 

Criminalization of poor and unhoused people will continue to expand so long as the reins on America’s neoliberal approach to fiscal and social policy remain untethered. 

We must seek the commonalities between our communities in order to thread the power of our organizing together!

For 21 years, we’ve worked alongside @lacanetwork_ For 21 years, we’ve worked alongside @lacanetwork_official and other local groups, with community outreach guiding all our campaigns. 

The #Right2Rest Bill was introduced in Colorado, Oregon, and California, and WRAP member groups in all three states built it together from the same outreach to our collective community. 

It lost nine times across those states.
